Terms and Conditions

1. Introduction

These Terms & Conditions govern all bookings, stays, services, and use of the Ojalá Casa properties and platforms, including our locations in Tenerife and Marbella, Spain.

By making a reservation, accessing our properties, or using our website, you agree to comply with these Terms & Conditions.

Ojalá Casa is a coliving and hospitality concept designed around respectful shared living, wellbeing, flexibility, remote work, and community-oriented stays.

2. Eligibility

3. Eligibility

Guests must be at least 25 years old to book or stay at Ojalá Casa, unless otherwise approved by management.

Ojalá Casa is designed primarily for mature adults, remote professionals, and community-oriented guests seeking a calm and respectful living environment.

We reserve the right to refuse or cancel any booking at our discretion where we believe a guest may not be suitable for the coliving environment or may negatively affect the safety, comfort, or experience of other residents.

All guests may be required to provide valid government-issued identification before or during check-in.

4. Bookings & Payments

A reservation is only considered confirmed once the required payment has been successfully received and confirmation has been issued by Ojalá Casa.

Payment conditions may vary depending on:

  • accommodation type
  • length of stay
  • seasonal offers
  • promotional conditions

For selected stays, a deposit or advance payment may be required.

The remaining balance, where applicable, must be paid before arrival according to the booking conditions communicated during the reservation process.

Ojalá Casa reserves the right to cancel unpaid reservations.

Payment instructions will be provided during or after the booking process.

5. Security Deposits

Ojalá Casa reserves the right to request a refundable security deposit prior to check-in.

The security deposit may be used to cover:

  • property damage
  • lost keys or access devices
  • unpaid balances
  • excessive cleaning
  • violations of house rules resulting in additional costs


Refunds, where applicable, are generally processed after inspection of the accommodation following check-out.

6. Check-In & Check-Out

Check-in and check-out instructions will be communicated prior to arrival.

Guests are expected to respect the agreed arrival and departure times unless otherwise approved in writing.

Late departures may result in additional charges.

Guests must leave the accommodation in a reasonable and respectful condition upon departure.

7. Cancellations & Refunds

Short-Term Stays (less than 30 nights)
  • Cancellations made more than 60 days before arrival are eligible for a full refund, excluding processing fees.
  • Cancellations made between 30 and 59 days before arrival are eligible for a 50% refund.
  • Cancellations made less than 30 days before arrival are non-refundable.
  • No-shows and unused nights are non-refundable.

Long-Term Stays (30 nights or more)
  • Long-term reservations require a minimum commitment as agreed during booking.
  • The first month of stay is non-refundable once the reservation has been confirmed.
  • Guests wishing to shorten or terminate their stay early must provide at least 30 days written notice.
  • Security deposits may remain refundable subject to inspection and outstanding balances.
  • Early departures and unused nights are non-refundable.

Promotional & Discounted Rates

Bookings made under promotional, discounted, early-bird, or special-rate conditions may be partially or fully non-refundable.


Exceptional Circumstances

Any exceptions to the cancellation policy remain solely at the discretion of Ojalá Casa.

8. Community & Shared Living

Ojalá Casa is built around respectful shared living and community-oriented hospitality.

Guests are expected to contribute positively to the atmosphere and wellbeing of the property and its residents.

The following behaviors are strictly prohibited:

  • illegal activities
  • aggressive or abusive behavior
  • harassment or discrimination
  • excessive noise or repeated disturbances
  • dangerous conduct affecting guests, staff, or property
  • unauthorized parties or events

Guests must respect shared spaces, neighbors, staff, and fellow residents at all times.

9. Quiet Enjoyment & Noise Policy

To preserve a calm and comfortable environment for all guests, residents must avoid disruptive behavior, particularly during evenings and nighttime hours.

As many residents work remotely or stay for extended periods, excessive noise, loud music, speaker calls, or repeated disturbances may result in warnings or termination of the stay.

 

10. Visitors & Overnight Guests

Unauthorized overnight guests are not permitted unless approved in advance by Ojalá Casa.

Visitor access may be restricted depending on the accommodation type, occupancy limits, and community setting.

Ojalá Casa reserves the right to charge additional fees or terminate stays where visitor policies are violated.

11. Smoking, Alcohol & Illegal Substances

Smoking is only permitted in designated outdoor areas where applicable.

Illegal drugs and unlawful substances are strictly prohibited on the property.

Alcohol consumption must remain respectful and may not negatively impact the comfort, safety, or wellbeing of other guests.

12. Internet & Remote Work

WiFi and internet access are provided as a convenience to guests.

While Ojalá Casa aims to provide reliable connectivity, uninterrupted or error-free internet service cannot be guaranteed.

Ojalá Casa shall not be held liable for:

  • internet outages
  • slow connections
  • third-party provider interruptions
  • business losses related to connectivity issues

Guests remain responsible for maintaining their own backups, devices, and business continuity arrangements

13. Property Access & Maintenance

Ojalá Casa reserves the right to access accommodations when reasonably necessary for:

  • maintenance
  • repairs
  • cleaning
  • emergencies
  • safety concerns
  • legal compliance

Whenever reasonably possible, prior notice will be provided.

14. Liability

Guests remain responsible for their own personal belongings, valuables, equipment, and vehicles during their stay.

Ojalá Casa shall not be held liable for:

  • theft
  • loss of personal property
  • injuries
  • accidents
  • delays
  • service interruptions
  • force majeure events
  • third-party provider failures

Guests remain liable for damages caused by themselves, their visitors, or any person accessing the property through them.

15. Registration Requirements

In accordance with Spanish regulations, guests may be required to provide personal identification information prior to or during check-in.

This information may be processed and shared with the relevant Spanish authorities as legally required.

Failure to provide the required information may result in denied access or cancellation of the reservation.

16. Termination of Stay

Ojalá Casa reserves the right to terminate a stay immediately and without refund in cases including, but not limited to:

  • serious misconduct
  • repeated violations of house rules
  • non-payment
  • illegal activity
  • dangerous behavior
  • conduct negatively affecting other guests, staff, neighbors, or the community atmosphere

Where necessary, local authorities may be contacted.

17. Privacy

Personal information is processed in accordance with applicable privacy and data protection laws.

By making a booking or using our services, guests consent to the collection and processing of relevant personal information necessary for operational, legal, and hospitality purposes.

18. Force Majeure

Ojalá Casa shall not be held responsible for failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to:

  • natural disasters
  • power outages
  • internet failures
  • government actions
  • pandemics
  • strikes
  • weather events
  • infrastructure disruptions

19. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Spain.

Any disputes arising in connection with these Terms shall fall under the jurisdiction of the competent courts corresponding to the registered office of SOL Y TIEMPO SLU.
